President Rodrigo Duterte today said that Ombudsman’s charges against former President Benigno III regarding the bloody Mamasapano encounter will eventually fail. He said the recommendation was “bugok”.
“You know the President is the Commander-in-Chief of all armed forces, the police is a civilian entity under DILG, [the President] is also the chief of the executive department,” President Duterte told reporters in Malacañang.
“If I order [as President] an operation, and from my mouth I would say: go there and fight or arrest this person or maintain order, that by itself is like the Commander-in-Chief, chief executive ka,” he said.
“‘Yung ginawa ng mga pulis at ni [former national police chief] Purisima – hindi mo masabi usurpation of authority because lahat na sinabi nila ay merged in one person, the chief executive, the president,” he explained. “He can call anybody to help him to fight a criminal operation there.”
Duterte said Aquino was not using the administrative talent in appointments, in signing, he was just asking for the advice from a professional police. “I do not see anything wrong there,” Duterte said.
“Nothing was signed, nothing was agreed by Purisima except that he was helping the President implement the law. Ngayon kung sino utusan niya wala kang pakialam because he has the trust,” President Duterte noted.
Ombudsman Conchita Carpio Morales ordered the filing of Usurpation of Authority case under Article 177 of the Revised Penal Code and violation of Section 3(a) of the Anti-Graft and Corrupt Practices Act (Republic Act No. 3019) against Aquino.
